The Tribunal da Relação de Lisboa dismissed the appeal regarding a charge of infidelity, ruling that the crime is a specific property offense requiring actual financial loss. The prosecution argued the defendant's actions constituted the crime, but the court emphasized that the typical description mandates a concrete, significant prejudice to the victim's assets. Consequently, the court established that without proven substantial financial damage, the essential elements of the crime are not met.

SUMÁRIO

I - No crime de infidelidade o bem jurídico tutelado é o património.
