The Tribunal Central Administrativo Sul dismissed the applicants' request for suspension of a pharmacy transfer decision, ruling that their alleged 20% business loss was merely conjectural. The applicants argued this potential revenue drop constituted irreparable harm under Article 76 of the Administrative Procedure Law, but the court found the damage to be probabilistic rather than certain. Consequently, the court held that such hypothetical and uncertain financial losses do not meet the legal threshold for irreparable harm required to suspend an administrative act.
