The Supreme Court of Justice denied the review of the lower court's decision to require fact-finding on alleged abuse of rights. The appellant failed to limit the appeal's scope, preventing the appellate court from assessing the sufficiency of contested facts at the summary stage. Consequently, the court ruled that determining whether facts are sufficient for a merits judgment is exclusively the competence of the trial instances.
