Qualified theft cases require preparatory instruction by the court, not preliminary inquiry by the prosecutor.
Legislator summary
AI generatedThe court declared that qualified theft cases must undergo preparatory instruction by the Tribunal de Instrução rather than a preliminary inquiry by the Ministério Público. The defendant argued for a preliminary inquiry, but the court emphasized that since qualified theft is a crime requiring a querela process, the specific procedural rules of Decreto-Lei 605/75 mandate court-led instruction. Consequently, the decision established that the initial phase of proceedings for this offense must be conducted by the judicial authority to ensure proper handling of the querela requirements.
