The Supreme Court of Justice denied the request to review the collective decision regarding a commercial dispute. The court held that only the Relação possesses the power to annul the collective's decision, and the Supreme Court's role is limited to censuring the use of the power granted by Article 712 of the Civil Procedure Code. Furthermore, the court found that the buyer assumed the risk for the goods because the sale was made 'à partida inteira' (by the whole lot) under Article 427 of the Commercial Code, despite the alleged poor quality of the apples.
