The Supreme Court of Justice rejected the appeal, ruling that the requested review concerned new factual matters not previously adjudicated. The court emphasized that all defenses must be explicitly stated in the contestation within the statutory boundaries of the Civil Procedure Code. Consequently, the court held that it lacks jurisdiction to decide on new facts, reserving such authority solely for the lower instances.
