The Supreme Court of Justice granted the review, permitting the expansion of factual findings without annulling the lower collective court's decision. The court held that Article 729, paragraph 3, of the Civil Procedure Code does not restrict the Supreme Court's power to expand facts when necessary for a legal decision under Article 730, paragraph 1. Consequently, the Tribunal da Relação must order the annulment of the lower decision to facilitate the new trial.
