The Supreme Court of Justice clarified the distinction between defense by exception and defense by impugnation regarding the attack on legal facts. The defendant argued that the plaintiff's claim was invalid by challenging the legal consequences of the signed documents rather than the signatures themselves. The court ruled that this constitutes a defense by exception because it accepts the facts but opposes their juridical effect, shifting the burden of proof to the plaintiff regarding the authenticity of the signatures.
