SUMÁRIO

I - O direito de preferência concedido ao proprietário de prédio onerado com servidão de passagem dependente de esta ter sido constituída a favor de prédio encravado - artigo 1555 do Código Civil.

II - É prédio encravado, como encrave absoluto, o que foi ladeado por terrenos alheios, interpostos entre ele e a via pública, a favor do qual pode ser estabelecida mais do que uma passagem - artigo 1550 do Código Civil.

III - Configurando-se essa situação objectiva, as passagens que tiverem sido estabelecidas devem ser qualificadas, em princípio, como servidões legais.

IV - Estando o Autor nestas circunstâncias, tem o direito de preferência referido.
