The Supreme Court of Justice rejected the appeal, ruling that it cannot decide on the necessity of an investigative act but only its legality. The case involved a paternity investigation where the court suspended the civil instance pending the criminal trial regarding rape. The court held that biological filiation is a provable fact and the civil judge may rely on the criminal proceedings to determine the action's admissibility.
