SUMÁRIO

I - Embora o S.T.J., em regra, tenha de acatar a matéria de facto provada pelas instâncias, não está sujeito

à qualificação jurídica dada por aquele tribunal ao crime imputado ao recorrente, podendo reexaminar a matéria de direito.

II - O reexame da fixação da indemnização civel é da competência do S.T.J..

III - Não é, pois, de rejeitar o recurso por manifesta improcedência, se estiver em causa o montante da indemnização, com a qual, o recorrente, se não conforma.
