Foi a anómala, incomum conduta da vítima que desencadeou e originou o acidente, visto seguir no passeio, a cambalear, embatendo num dos peões que circulava nesse passeio perdendo o equílibrio e caindo sobre a passadeira de peões, na faixa de rodagem, onde se deu o embate com o veículo AM-19-18, do Estado, que circulava a 25 km/h e se encontrava a 5 a 6 metros quando a vítima caiu, não havendo responsabilidade do condutor do veículo pelo risco.
