Dismissal for unjustified faults requires proof of culpability and immediate impossibility of work continuation.
Legislator summary
AI generatedThe court dismissed the employer's claim for dismissal based on unjustified faults, ruling that the worker's prior notification of these infractions prevented them from being deemed unjustified without further proof. The employer argued the faults constituted just cause, but the court held that such faults only justify dismissal if proven to be culpable and severe enough to make continued employment immediately impossible. Consequently, the review was denied because the employer failed to meet the strict burden of proof required by the relevant labor decree.
