SUMÁRIO

I - O Acórdão da Relação que considera fixados factos que estão em contradição com outros factos igualmente julgados provados, enferma de nulidade prevista no artigo 668 n. 1 b, por força do estatuído no artigo 716 n. 1, do Código de Processo Civil de 1967.

II - Em tal caso, deve o processo baixar à Relação para reforma da decisão anulada pelos mesmos Juízes se possível.
