SUMÁRIO

I - O cultivo, não autorizado, de alguns milhares de pes de "Cannabis Sativa L", destinados em parte a consumo pessoal do reu e noutra parte a finalidade ainda que não lucrativa, integra a pratica de um crime previsto e punivel pelo artigo 23, n. 1, do Decreto-Lei n. 430/83, de 13 de Dezembro.

II - Tendo o reu utilizado a sua viatura automovel para transportar as plantas desde o local de cultivo ate a sua residencia, deve tal veiculo ser declarado perdido para o Estado, por ao crime corresponder pena maior - artigo 1 da Lei n. 41/85, de 14 de Agosto - e ainda nos termos do artigo 63 do Codigo da Estrada e artigo 107, n. 1, do Codigo Penal.

III - Não e permitida a aplicação de prisão em alternativa quando a multa seja de quantia determinada, face ao Codigo Penal vigente.
