I - O titular do direito de propriedade, reconhecido que lhe seja esse direito, pode exigir judicialmente a restituição da coisa a qual so pode ser recusada nos casos previstos na Lei.

II - Da Lei 68/78 resulta que a restituição de estabelecimento pedida, pelo proprietario dele sera julgada improcedente, se se provar que a autogestão foi justificada.

III - Se esta prova se não fizer, procedera a acção de restituição.
