Portuguese court allows debt assumption under unjust enrichment but rejects formal novation requirements.
Legislator summary
AI generatedThe court permitted the tribunal to reclassify facts under unjust enrichment rather than the initially presented legal framework, citing Articles 264 and 664 of the Civil Procedure Code. While the assumption of debt was accepted, the court clarified that without subjective novation, the act merely changes the debtor without altering the original obligation's formal defects. Consequently, the assumer inherits the status of the original unjustly enriched party, including all implications regarding the validity of the debt's form.
