The Supreme Court of Justice unanimously dismissed the criminal appeal against a conviction for arson. The appellant argued for a new trial based on alleged procedural defects, but the court held that such vices must appear explicitly in the judgment text or be obvious from common experience. Furthermore, the court affirmed that the trial court could not re-evaluate the evidence under the principle of free assessment of proof, and ruled that the crime of arson is a crime of danger, requiring only proof of risk to life or property, regardless of the actual damage caused.
