The administrative court dismissed the appeal filed by Manuel Castro against the City of Lisbon's decision to impose works on a property partially designated for habitation. The appellant argued for the exclusion of power deviation, but the court found the issue did not involve discretionary power since the risk of fire in a liquor store was a normal hazard. Consequently, the court ruled that Article 151 of the General Urban Regulations does not distinguish between normal and special fire risks in such commercial premises.
