Portuguese court rules interruption of tax prescription persists after judicial stay if process remains pending for over a year.
Legislator summary
AI generatedThe Supreme Administrative Court dismissed the taxpayer's request for jurisdictional review regarding the interruption of tax prescription. The taxpayer argued that a judicial stay of the fiscal execution process should suspend the prescription period, but the court held that such a stay does not transform an interruption into a suspension. Consequently, the court ruled that the interruption effects continue to apply, preventing the prescription from running during the pending proceedings. The decision clarifies that a mere procedural pause does not alter the legal nature of the interruption established by prior acts.
