The Supreme Administrative Court unanimously upheld the VAT waiver regime for real estate transactions against a challenge regarding the right to deduct input tax. The Recurrent argued that the mandatory prior option to waive exemption violated the automatic nature of deduction rights and EU neutrality principles. The court ruled that the waiver system does not limit the deduction right, as taxpayers can still deduct VAT paid on the waiver, thereby preserving community law compliance.

SUMÁRIO

I - O regime de renúncia à isenção de IVA nas operações relativas a bens imóveis que deriva do artigo 4.º, n.º 2, do Decreto-Lei n.º 241/86, de 20 de agosto e – depois dele – do artigo 5.º do anexo ao Decreto-Lei n.º 21/2007, de 29 de janeiro, não é incompatível com as regras do direito à dedução inseridas no n.º 1 do artigo 20.º do Código do Imposto sobre o Valor Acrescentado;
