Supreme Administrative Court dismisses review appeal challenging the application of Article 88(3) RJUE facts.

The Supreme Administrative Court unanimously dismissed the review appeal filed by the applicant against the decision of the Tribunal Administrativo de Figueira da Foz. The applicant argued that the Tribunal incorrectly applied the regime established in Article 88(3) of the RJUE regarding the factual assessment. The court held that the review procedure is not the appropriate forum to question the factual findings already made by the first-instance tribunal.
