The Supreme Administrative Court unanimously allowed the appeal filed by the Ministry of Ultramar against a delegation of powers act. The Ministry argued it had the standing to contest the subsecretary's dispatch, while the counterparty contested the scope of the delegation and the tax exemption. The court ruled that the delegation of powers was valid for the Ministry to act as a legitimate party and that a customs duty exemption in an administrative contract does not automatically exempt other specific taxes like the Angola Development Fund levy.
