Portuguese court upholds tax collection presumption of legality, rejecting constitutional challenge to industrial contribution notice.
Legislator summary
AI generatedThe Supreme Administrative Court dismissed the taxpayer's appeal against a tax liquidation notice, ruling that administrative acts enjoy a presumption of legality. The court held that the burden of proving the facts supporting the tax lies with the appellant, not the state, and that the notification does not require constitutional justification for the industrial contribution. Consequently, the court found no violation of constitutional rights despite the existence of other taxes.
