SUMÁRIO

I - É contenciosamente recorrível a autorização tácita da Câmara Municipal que aprovou a construção de dois depósitos de água, por considerar que os mesmos não careciam de licenciamento, sendo neste caso objecto do recurso contencioso o "acto implícito" e não o acto, ou actos concludentes de onde, necessariamente, se infere.

II - É tempestivo o recurso contencioso desse acto implícito (autorização tácita) interposto dentro do prazo referido no art. 28º da LPTA contado a partir da entrega da certidão a que se refere o art. 29º do mesmo diploma, certidão essa que nem sequer continha todos os elementos necessários à identificação do acto, data da sua formação, e respectiva fundamentação.
