The Supreme Administrative Court of Portugal unanimously ruled that specific stamp duty exemption provisions in the Corporate Income Tax Code violate EU law. The court found that limiting exemptions to creditors with headquarters outside Portugal, rather than debtors, restricts the freedom of capital movement under Article 63 of the TFEU. Consequently, the court declared these restrictive clauses incompatible with the EU legal framework.
