Legislator summary

AI generated

The court ruled that the deadline for judicially challenging a tax liquidation act begins only after the tacit or express rejection of a voluntary tax refund claim. The taxpayer argued that the standard challenge period should start from the payment deadline, while the tax authority contended otherwise. The court established that the rejection of the refund claim interrupts the timeline, granting the taxpayer 90 days from the tacit rejection or 15 days from an express decision to file the judicial appeal.
