I - As sociedades cooperativas adquirem personalidade juridica por reconhecimento normativo e não podem ser dissolvidas por acto administrativo.

II - So aos tribunais judiciais compete decidir da inexistencia das sociedades que se constituam ou funcionem em contravenção das disposições do Codigo Comercial.

III - Esta ferido de usurpação de poder o acto da Administração que declara a ilegal constituição de uma sociedade cooperativa para a sujeitar ao regime de reconhecimento e dissolução das associações.
