The administrative court dismissed the jurisdictional appeal filed by Antonio Botelho against the licensing of a private construction project. The appellant argued that the mayor's decision violated legal principles and failed to properly consider conditional opinions from relevant entities. The court held that the administrative act remains valid even if tacitly relying on favorable preliminary opinions, and that the appellant must actively allege and prove specific facts demonstrating illegal intent or procedural violations rather than merely stating conclusory judgments.
