Legislator summary

AI generated

The hierarchical appeal was rejected because the express refusal issued after the statutory ninety-day deadline is deemed a confirmation of the earlier tacit refusal. The appellant argued for a new decision within the prescribed time, while the court held that the subsequent express act validates the initial silence unless based on facts suggesting abuse of power. Consequently, the court ruled that the procedural timeline for a fresh decision was extinguished by the confirming act.
