Opposition to tax court rulings requires identical facts, legal contradiction, and lack of alignment with newer consolidated jurisprudence.
Legislator summary
AI generatedThe court held that a tax opposition appeal against a prior ruling requires meeting three cumulative legal requirements. The appellant argued for a contradiction between the challenged decision and a foundational precedent, but the court found the challenged ruling aligned with the most recent consolidated jurisprudence of the Supreme Administrative Court. Consequently, the appeal was partially dismissed because the second requirement regarding the absence of alignment with newer case law was not met.
