Civil liability for administrative illegibility requires fault, which merges into the illegality of the act under the cited law.
Legislator summary
AI generatedThe Supreme Administrative Court dismissed the appeal regarding civil liability for administrative illegibility. The court held that under the broad definition of illegality in the cited law, a clear boundary between illegality and fault is difficult to establish. Consequently, the subjective element of fault dissolves into the objective illegality, making the agent's culpability dependent on violating known legal or prudential rules.
