The Supreme Administrative Court dismissed the opposition to tax execution because the initial petition was declared incompetent. The lower court found the petition inept as it raised defects unrelated to the request and failed to address the citation nullity and lack of notification of reversal decision. Consequently, the court held that substantive grounds like prescription could not be examined until the procedural defect of the initial filing was resolved.
