Jurisdictional appeal dismissed when lower court already ruled administrative court competent, rendering conflict resolution moot.
Legislator summary
AI generatedThe Tribunal of Conflicts refused to examine the jurisdictional appeal because the lower court had already determined the administrative court was competent. The appellant argued for civil court jurisdiction, but the procedural outcome was moot since the administrative court's competence was established. Consequently, the court held that no formalistic requirements of older decrees applied, instead relying on the Civil Procedure Code to dismiss the appeal as unnecessary.
