Italian court dismisses appeal as arguments against non-prosecution habit are manifestly unfounded and specific.
Sintesi Legislator
Generato dall'IAThe Court of Cassazione declared the appeal by Raffaele Piesco inadmissible, ruling that his challenges to the lower court's application of the non-prosecution habit were manifestly unfounded and specific. Piesco contested the lack of application of Article 131-bis of the Penal Code, but the appellate court had already highlighted the obstructive habit based on three prior convictions for the same offense under Article 76 of Legislative Decree 159/2011. The court rejected the appeal because these censure did not meaningfully engage with the reasoning regarding the established habit of offending.
