The Italian Court of Cassation declared the appeal filed by Walid Ben Ammar inadmissible and ordered him to pay court costs. The sole ground of appeal contested the violation of law and lack of reasoning concerning Article 62 bis of the Penal Code regarding punitive treatment. The court ruled that while the appellant's arguments were sufficiently motivated, the issue pertained to the punitive aspect of the sentence rather than substantive legal errors, rendering the appeal inadmissible.

Ordinanza — n. 38461/2025 — snpen
Criminal appeal dismissed as inadmissible due to prescription occurring after the appealed judgment. The court ruled the appeal's argument regarding prescription is unfounded because the prescription period expired after the appellate decision was rendered. Consequently, the appeal is declared inadmissible, and the appellant is ordered to pay court costs and a fine. The court emphasized that the inadmissibility of the appeal precludes any examination of the prescription issue that arose post-judgment. The decision relies on established case law regarding the timing of prescription and the procedural consequences of filing an appeal after the limitation period has expired. The court found the appellant's interpretation of the law to be in clear conflict with statutory norms and binding precedent. The final outcome confirms the lower court's judgment stands without further review on the merits of the prescription defense.

Cassation court dismisses appeal as res judicata applies to prior partial annulment regarding conditional suspension. The appeal is inadmissible because the specific legal issue was already definitively ruled upon by the Supreme Court in a previous decision that partially annulled the lower court's judgment. Since the question of whether the conditional suspension of the penalty could be granted without the demolition order was already settled by the rescinding judgment, the appellate court's new ruling on this point cannot be re-examined. The court therefore declares the appeal inadmissible based on the principle of res judicata, which prevents the re-litigation of issues already decided by the Supreme Court in a prior partial annulment. The appellant is condemned to pay the procedural costs and a fine. The court emphasizes that the principle of res judicata applies to all points of the decision that are susceptible of autonomous consideration and have become final.
