Court dismisses appeal because the charged crime is extinguished by prescription due to the date of commission.
Sintesi Legislator
Generato dall'IAThe Court of Cassation annulled the second-instance judgment without remanding the case, ruling that the alleged crime was extinguished by prescription. Although the defense argued that funds were exclusively maternal and thus the presumption of joint ownership under Article 1854 of the Civil Code did not apply, the court found this insufficient to prove the absence of the crime itself. Consequently, the court determined that since the offense occurred on September 5, 2016, it had expired under the relevant criminal procedure statutes.

CONSIDERATO IN DIRITTO
Letto il ricorso presentato nell'interesse di Vincenzo Caruso; rilevato, che gli argomenti addotti dalla difesa dell'imputato in relazione alla origine esclusivamente materna delle somme depositate sul conto corrente cointestato e sulla conseguente inapplicabilità della presunzione ex art.1854 c.c. al caso di specie non sono manifestamente infondati; considerato tuttavia che l'argomento difensivo non è tale da dimostrare ex se l'insussistenza del reato ex art. 129 c.p.p.; rilevato che il reato contestato risulta commesso, in base all'imputazione, in data 5 settembre 2016 e deve pertanto considerarsi prescritto, in assenza di rilevanti ipotesi di sospensione della prescrizione;
P.Q.M.
