Cassation court dismisses appeal as inadmissible due to already examined and rejected arguments on non-punishability and probation. The court rejects the request to apply Article 131-bis CP and probation under Law 689/1981. The appeal is inadmissible because the substantive issues were already fully reviewed and dismissed by the lower court with legally sound reasoning. The court finds no grounds for re-examination and upholds the original judgment. The decision confirms the finality of the lower court's assessment on probation eligibility and non-punishability defenses. The appellant bears the costs of the proceedings. The ruling emphasizes the binding nature of prior judicial evaluations on these specific criminal law points. The court maintains that the lower court's decision stands without further review.
