Italian Court dismisses appeal for home detention due to lack of specific grounds and high social danger. The court ruled the appeal inadmissible because the sole ground raised was too vague to be examined on merits. The Tribunal of Surveillance had already found the prisoner socially dangerous based on recent cautionary measures, which the appellant failed to refute. Consequently, the appeal was declared inadmissible, and the appellant was ordered to pay court costs and a fine. The decision reinforces that vague arguments cannot bypass preliminary admissibility checks in Italian surveillance proceedings. This case highlights the strict requirement for specificity in appeals against detention measures. The court emphasized that even if the sentence is served, new risks can justify continued detention. The ruling ensures that procedural flaws prevent substantive review of potentially dangerous prisoners. Ultimately, the court prioritized procedural rigor over the appellant's claim of completed sentence execution.
Sintesi Legislator
Generato dall'IAThe Court of Cassazione declared Vincenzo Oliviero's appeal inadmissible for failing to provide specific grounds for challenging the home detention order. The Tribunal of Surveillance had previously determined the prisoner posed a high social risk due to recent cautionary measures, despite the appellant arguing he had fully served his sentence. The court rejected the appeal because the sole ground raised was too vague to warrant a substantive examination, thus upholding the lower court's decision on admissibility.

a seguente ORDINANZA sul ricorso proposto da: OLIVIERO VINCENZO nato a TORRE DEL GRECO il 30/06/1995 avverso l'ordinanza del 19/09/2023 del TRIB. SORVEGLIANZA di MILANOdato avviso alle parti; udita la relazione svolta dal Consigliere FRANCESCO ALIFFI;

CONSIDERATO IN DIRITTO
Visti gli atti. Esaminati il ricorso e l'ordinanza impugnata.
