Cassation appeal dismissed as inadmissible because it challenges facts and evidence rather than legal errors.
Sintesi Legislator
Generato dall'IAThe Procuratore Generale appealed a first-instance acquittal against Giuseppe Barracca for voluntary injuries, citing alleged motivational defects. The Court of Cassation rejected the appeal because the grievances focused on factual re-evaluation and evidence assessment, which are reserved for the trial court. Consequently, the appeal was declared inadmissible as the Supreme Court cannot review the merits of the case.
