The court declared the cassation appeal extinguished following the plaintiffs' formal withdrawal of the case on March 19, 2025. The plaintiffs had previously sought a second-level collective bargaining agreement classification or wage differentials against the Ministry of Defense and the Defense Industries Agency, losing at both the trial and appellate levels. Because the withdrawal occurred after the defense was filed, the court ruled that the procedural dismission justified compensating the state for the costs incurred in the proceedings.

Ordinanza — n. 7323/2026 — snciv
Italian Supreme Court dismisses appeal for inadmissibility due to procedural errors and late filing. The court rejects the appeal because the appellant failed to properly transcribe the lower court's reasoning, did not address specific procedural defects raised by the opposing party, and attempted to raise a new ground of inadmissibility after the statutory deadline had expired. Consequently, the appeal is declared inadmissible under Article 360 of the Code of Civil Procedure. The court emphasizes that while a direct examination of the record is permitted for certain procedural errors, the appellant must first demonstrate the admissibility of the specific ground of complaint. Furthermore, the court notes that the appellant's attempt to challenge the lower court's reliance on evidence introduced late in the appeal phase is unfounded, as the appellate court correctly utilized evidence from the first instance where the opposing party was absent. Finally, the court clarifies that the appellant's claim regarding insufficient motivation is time-barred because the relevant legislative amendment took effect after the lower court's decision was rendered, rendering the new procedural requirement inapplicable to this case. The appeal is therefore dismissed as inadmissible, and no further orders are issued regarding costs since the appellant merely appeared without filing a counter-appeal.
