uente DECRETO sul ricorso iscritto al n. 8923/2024 R.G. proposto da: AVV. QUAGLIARELLA GIACOMO; -ricorrente – contro U.T.G. di Potenza, in persona del Prefetto p.t.; -intimato – avverso la sentenza del Tribunale di Potenza n. 163/2024, pubblicata il 31 gennaio 2024. Vista la sintetica proposta di definizione anticipata del giudizio, formulata ai sensi dell’art. 380-bis, comma 1, c.p.c., come comunicata al ricorrente; rilevato che è trascorso il termine di 40 (quaranta) giorni dalla comunicazione dell’anzidetta proposta, senza che il ricorrente abbia chiesto la decisione del ricorso; ritenuto, per l’effetto, che il ricorso deve – ai sensi del citato art. 380-bis, comma 2, c.p.c. - intendersi rinunciato e che deve provvedersi alla dichiarazione di estinzione del giudizio di cassazione; atteso che non occorre adottare alcuna statuizione sulle spese del presente giudizio, non avendo l’intimato U.T.G. svolto attività difensiva in questa sede;
