CORTE SUPREMA DI CASSAZIONE SECONDA SEZIONE CIVILE IL CONSIGLIERE DELEGATO Esaminati gli atti del procedimento iscritto al R.G. n. 2941/2024; vista la sintetica proposta di definizione anticipata del giudizio, formulata ai sensi dell’art. 380-bis c.p.c., come comunicata ai difensori delle parti; rilevato che è trascorso il termine di 40 giorni dalla comunicazione dell’anzidetta proposta, senza che parte ricorrente abbia chiesto la decisione del ricorso; ritenuto, per l’effetto, che il ricorso deve intendersi rinunciato e che deve provvedersi alla dichiarazione di estinzione del giudizio di cassazione; atteso che deve provvedersi alla condanna alla refusione delle spese di lite a carico della parte che ha dato causa al procedimento, che si liquidano come in dispositivo;

M. visti gli artt. 380-bis e 391 c.p.c., dichiara l’estinzione del giudizio di cassazione e condanna il ricorrente alla refusione, in favore del controricorrente, delle spese di lite, che liquida in complessivi euro 2.600,00, di cui euro 200,00 per esborsi, oltre accessori come per legge.
