uente DECRETO sul ricorso iscritto al n.11600/2023 R.G. proposto da : MALDARIZZI AUTOMOTIVE SPA, elettivamente domiciliato in ROMA VIA XX SETTEMBRE N. 3, presso lo studio dell’avvocato MICCOLIS GIUSEPPE (MCCGPP60R31A662X) che lo rappresenta e difende unitamente all'avvocato Calcagnile Luca (CLCLCU80C03A622K) -ricorrente- contro LA ROTONDA SPA IN LIQUIDAZIONE IN CONCORDATO PREVENTIVO, CURATELA FALLIMENTO EMME EMME SPA -intimati- avverso SENTENZA di CORTE D'APPELLO BARI n.241/2023 depositata il 16/02/2023. letta la rinuncia al ricorso del ricorrente ritenuto che la rinuncia ha i requisiti richiesti dagli articoli 390 e 391 c.p.c.;che l’estinzione può essere dichiarata con decreto ai sensi dell’art.391 c.p.c., come modificato dal d.l. n. 68 del 2016, convertito con modificazioni dalla legge n. 197 del 20 16; che nulla va statuito sulle spese, stante la mancanza di difese della parte intimata;
