Civil court declares lawsuit extinguished due to statutory time limits for appeal declaration. The court ruled the case extinguished because the statutory deadline for filing an appeal declaration had passed without objection, as mandated by the relevant procedural law. Consequently, the court declared the proceedings extinguished and assigned costs to the party who had advanced them, adhering to the strict temporal requirements of the civil procedure code. The decision confirms that the expiration of the appeal window automatically terminates the legal action unless a specific request for scheduling is made. This outcome reinforces the principle that procedural deadlines are mandatory and cannot be extended unilaterally by the parties.
