ha pronunciato la seguente ORDINANZA sul ricorso iscritto al n.22090/2018 R.G. proposto da : GARGIULO VERA, elettivamente domiciliato in NAPOLI VIA A.RUIZ 107, presso lo studio dell’avvocato CONSOLI RODOLFO (CNSRLF42H16F839S) che lo rappresenta e difende unitamente all'avvocato CONSOLI ANDREA (CNSNDR72M07F839N) -ricorrente- contro FALLIMENTO DOTT SSA VERA GARGIULO -intimato- avverso SENTENZA di CORTE D'APPELLO NAPOLI n. 139/2018 depositata il27/06/2018. Udita la relazione svolta nella camera di consiglio del 26/06/2023 dal Consigliere ANDREA FIDANZIA. Il Collegio, rilevato che la ricorrente ha rinunciato al ricorso per cassazione con atto pervenuto in data 1.6.2023; che non occorre l’accettazione della rinuncia, non essendosi la parte intimata costituita in giudizio, e pertanto non occorre provvedere neppure sulle spese di lite.
