Cassation court dismisses appeal regarding appealability of tax notice extract when underlying debt notice was properly served.
Sintesi Legislator
Generato dall'IAThe Court of Cassation dismissed the appeal against a Siracusa Tribunal ruling that an extract of the tax roll was appealable despite proper notification of the underlying debt notice. The appellant argued the extract was unappealable because the debt notice had been served, while the court applied the principle that such appeals are permissible only if the debtor claims non-service or invalidity of the debt notice to recover Art. 24 constitutional protections. The court held that since the debt notice was validly served, the appellant lacked the necessary interest in action to challenge the extract.
Regesto Legislator
Generato dall'IAArt. 24 della Costituzione; Art. 666 c.p.c.: The appeal against an extract of the tax roll is admissible only when the taxpayer alleges non-service or invalidity of the underlying debt notice to claim constitutional protections or assert subsequent extinguishing events, creating an objective uncertainty about the right's existence.

Ric. 2021 n. 06192 sez.
