tY\ 99:5' ORDINANZA sul ricorso 4562/2016 proposto da: IAIONE ARTURO, difeso da sé stesso; - ricorrente - contro RUGGIERO SABINO, rappresentato e difeso dall'Avvocato SABINO VITAGLIANO per procura in calce al controricorso; - controricorrente e ricorrente incidentale - avverso la SENTENZA N. 4637/2015 della CORTE D'APPELLO DI NAPOLI, depositata il 2/12/2015; udita la relazione della causa svolta nella camera di consiglio non partecipata del 25/1/2022 dal Consigliere GIUSEPPE DONGIACOMO; rilevato che: - Ada Petrulio, Massimiliano Iaione, Fabio Iaione e Fernando Christian Iaione, in qualità di chiamati all'eredità del ricorrente, con atto in data 7/12/2021, hanno dichiarato di rinunciare al ricorso; - il controricorrente Sabino Ruggiero ha dichiarato, a sua volta, di accettare la rinuncia al ricorso; ritenuto che la rinuncia al ricorso comporta l'estinzione del giudizio di cassazione e che, a fronte dell'adesione del controricorrente, la condanna alle spese non è pronunciata (art. 391 c.p.c.).
