The Cassation Court allowed the appeal filed by ASL Napoli 1 against the Court of Appeal's dismissal of the appeal, ruling the lower court's decision on the appeal deadline was erroneous. The appellant argued the appeal was timely because the first-instance judgment was published on September 3, 2013, while the lower court incorrectly calculated the deadline starting from that date without accounting for the statutory suspension of terms due to public holidays. The court held that the appeal was not late because the deadline should have commenced on September 16, 2013, following the suspension period mandated by the relevant law.

MARCO MARULLI.

RITENUTO IN FATTO

CONSIDERATO IN DIRITTO
