Italian court declares asylum appeal extinguished due to applicant's formal withdrawal of the legal action.
Sintesi Legislator
Generato dall'IAThe Italian Court of Cassation declared the asylum appeal extinguished following the applicant's formal withdrawal of the legal action. The applicant, Niang Sidi Bara, submitted a written renunciation via PEC, prompting the court to verify compliance with procedural requirements under Articles 390 and 391 of the Code of Civil Procedure. The court ruled that since the applicant voluntarily withdrew the case, no further proceedings were necessary, and the judgment was issued without addressing the merits of the asylum claim.
